Institute Calls For Legal Review Committee Members

The Institute of Fundraising (‘Institute’) is calling for individuals to join its new Legal Review Committee on a voluntary basis, in order to ensure that the legal requirements set out in the Codes of Fundraising Practice remain well interpreted and up-to-date. The Institute’s Codes of Fundraising Practice are the benchmark for standards in UK fundraising, setting out the legal requirements, obligations for members of the Institute and issues of best practice.
The last 12 months have seen significant changes in regulations which are also set to continue, with the implementation of the Charities Act 2006, the Charities and Trustee Investment (Scotland) Act 2005, the Gambling Act 2005 and imminent charity legislation in Northern Ireland. Consequently, much of the legal content of the Codes of Fundraising Practice needs reviewing and updating.
The Institute would be pleased to receive applications to the Legal Review Committee from anyone with relevant experience, but in particular, applications are welcomed from:
– In-house charity lawyers; and
– Solicitors with a specialism in charity law of England and Wales, Scotland or Northern Ireland.
It is intended that the Committee will meet once every 6 weeks to review three of the 26 Codes per meeting. The Institute will act as secretariat for this Committee. A solicitor and member of the Institute’s Standards Committee will act as Chair.

Legal requirements in the Codes are identified by a ‘must’ command. The aim of the committee is to ensure that these ‘musts’ are still correct and that any new regulations are added to the Codes.
The role of the Codes of Fundraising Practice is more important today than it has ever been, in the self-regulatory environment that has followed the launch of the Fundraising Standards Board. It’s vital that we fully review and update our Codes to ensure they remain legally robust.”
